Terms Of Service

Domain Name Registration

1. You must make sure the domain name you wish to use for your hosting has been registered to you before applying for hosting with 2001 Web.

2. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant Registrar you must ensure that you are aware of those terms and conditions and that you comply with them.

3. We shall have no liability in respect of the use of any domain name registered by you. Any dispute between you and any other person/company must be resolved between the parties concerned we will not get involved in any way. We recommend you do not register any domain that is too close to the registered trademark of any company. (EG Yahooooooooo.com) In cases of legal dispute over a domain name, we reserve the right to suspend your hosting without giving reason until we are satisfied the dispute has been settled.

Web Site Hosting And Email

1. We make no representation and give no warranty as to the accuracy or quality of information received by any person via the 2001 web mail Server and we shall have no liability for any loss or damage to any data stored on the Server.

2. You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes and to promptly inform us if this clause or any sub clause of this clause has been breached or you become aware that they may have been breached. In particular, you represent, warrant and undertake to us that:

3. You will not use the Server in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorize or permit any other person to do so.

4. You will not upload, post, link to or transmit:

  • Any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way.
  • Any material containing a virus or other hostile computer program.
  • Any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.
  • Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of 2001 Web.
  • Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
  • Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
  • Any file that you do not own the copyright to in the first person, including mp3's, games (including mods, patches, and add-ons), free software, shareware, etc.

5. You will not send bulk email whether opt-in or otherwise from our network. Nor will you promote a site hosted on our network using bulk email. Let us be clear on this, if you use a bulk email service they will include the URL to your site. If enough people complain about the emails they send and we receive spam complains we will have no other choice but to suspend your service pending a full enquiry.

6. You will not employ programs which consume excessive system resources, including but not limited to processor cycles and memory.

7. Chat/IRC and web proxy scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.

8. Files that are not related to the use of your website may not be stored on our servers.  We randomly check all accounts for none linked files using a spider. If you are storing non related material on our server we will ask you to remove it. Refusal to co-operate may result in a service suspension.

9. We reserve the right to temporarily suspend any site containing material we deem inappropriate until such times as that material is removed or you find another service provider. LEGAL adult content is allowed at the
descression of 2001 Web, please check with us before opening your account.

10. You shall keep secure any identification, password and other confidential information relating to your account and shall notify us immediately of any known or suspected unauthorized use of your account or breach of security, including but not limited to loss, theft or unauthorized disclosure of your password or other security information.

11. You will be responsible at all times for keeping a full backup of your site including all files, images and database backups where applicable.

12. You shall procure that all mail is sent in accordance with applicable legislation and international anti-spam guidelines (including data protection legislation) and in a secure manner.

13. In the case of an individual User, you warrant that you are at least 18 years of age.

14. While we will use every reasonable precaution to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorized users or hackers and we shall be under no liability for non-receipt or mis-routing of email or for any other failure of email.

15. If you run a mailing list it MUST be double opt in and conform with international anti-spam laws. If you wish to have a legal mailing script installed, please contact us from the support page.

Newsletters And Mailing Lists

1. If you wish to send newsletters or have a regular members mailing list you MUST WITHOUT EXCEPTION use a legal double opt in mailing program.

2. In all newsletters your subscribers MUST be presented with a link to remove their email address from your list immediately. We are sorry but "reply with unsubscribe" to be removed is not acceptable.

3. Your mailing list software should record the IP address the user signed up from to safeguard you from spam complaints.

4. Your list must not send more than 200 emails an hour so please make sure your mailing program is throttled to that limit.

Service Availability

1. We shall endeavour to make available to you at all times the Server and the Services, but we shall not, in any event, be liable for interruptions of Service or down-time of the Server. 2001 Web will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by 2001 Web and its employees. 2001 Web reserves the right to revise its policies at any time.

Use Of Php Scripts

The use of php scripts is allowed on the 2001 Web servers with the following conditions.

1. All commercial php scripts including but not limited to shopping carts, notice boards, links programs, MUST be kept up to date. Should the authors of your program release a security update it must be installed IMMEDIATELY or as soon as is practically possible. 2001 web reserves the right to temporarily suspend any site using outdated or insecure scripts.

2. Scripts that require "globals on" are a security risk to any server, and therefore may not permitted on our servers. Please check with the authors of your scripts for a version that can run with globals turned off. Exceptions do exist for large commercial scripts that we know to be secure. If you are in doubt or need globals turning on for a particular application please contact support.

3. WYSIWYG server based scripts are not allowed at 2001web for security purposes. There are many PC based WYSIWYG programs available it is not necessary for this kind of program to be run on the server. This does not apply to built in editors in programs like cubecart. If you are unsure whether a program you use qualifies please contact support.

Payment

1. All charges payable by you for hosting services shall be in accordance with the scale of charges and rates agreed between you the client and 2001web.com on opening your hosting account, errors and omissions excepted, and shall be due and payable in advance of provision of the hosting Services.

2. Pricing for hosting will remain at the rate agreed with 2001web and the client for the life of the clients account. Prices will only increase should the client choose to upgrade their hosting package or if they are required to move to a dedicated server due to extreme use of server resources. WITHOUT EXCEPTION ALL hosting fees should be paid on or before their due date. Invoices for hosting are sent 4 days prior to the due date and a reminder sent one day before the due date. If hosting fees are not paid by the end of the due date a late invoice fee of £10 will be added to your invoice.

3. Without prejudice to our other rights and remedies under this Agreement, if any hosting fee payable is not paid by the due date, we shall be entitled but not obliged forthwith to suspend the provision of Services to you. In the event a hosting account is suspended it will not be reactivated until the invoice including any late fees is paid in full.

4. 2001 web regularly employs freelance designers and programmers on behalf of our clients, therefore payments for site design, custom programming or program installation must be paid in advance of any work commencing. Where possible 2001web will make escrow payments to the third party to protect the clients funds until the work has been completed, at which time the designer or programmer will be paid. By completing and submitting the electronic order form you are making an offer to purchase goods which, if accepted by us, is classed as a legal binding contract.

5. Site editing work performed by 2001 web staff will be billed by the minute according to the current published fees for site editing stated in the payments section of our knowledge base. These fees become due immediately when the work is completed however you will receive a 7 day grace period to make these payments. If editing bills are not paid within a 7 day period 2001web.com reserves the right to suspend your hosting until the invoice has been settled in full plus any associated late fees.

6. We recommend if you have temporary financial difficulties you contact us before your next hosting payment is due.

7. All payments will be in UK Pounds Sterling.

Termination And Refunds

1. We shall be entitled to suspend the Services and/or terminate this Agreement forthwith without notice to you If you:

  • Fail to pay any sums due to us as they fall due.
  • Break any of these terms and conditions.
  • Are a company and you go into liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors.

2. We reserve the right to suspend the Services and/or terminate this Agreement at any time.

3. Customers may cancel their account at any time. Fees are charged on a prepaid basis and are non-refundable.

4. Domain name registration fees, charges for additional data transfer and charges for optional extras added to your account are not refundable under any circumstances.

5. Where payment has been made by credit or debit card, any refund will only be issued to the same credit or debit card.

6. On termination of this Agreement or suspension of the Services we shall be entitled immediately to stop access to your Web Site and to remove all data located on the Server.

Services included in hosting fees

1. Providing of agreed web space and bandwidth.
2. 24/7 monitoring of your site for connectivity. All sites hosted by 2001 Web are continuously montiored by various outside services. If down time occurs we will be informed and work to correct any issues.

Services Not included in hosting fees

All the following types of work will incur additional charges if carried out by 2001web:

1. Repairs to any html page, php script, cgi script, asp script caused by incorrect editing or modification by the client or any outside service employed by the client.
2. Editing of any html page, graphic, flash graphic, or source code requested by the client.
3. Installation of any program or script automated or otherwise.
4. Custom programming or modification to any script by our programmers.
5. Any task that could have been performed by the client themselves.

Please note we do not offer support for any scripts or programs purchased from or written by third parties. However you may contact us to see if we can complete any repair, modification or augmentation of the scripts you use. We will quote you on this kind of work depending on the hours involved. Please note that the fees you will pay for installation or modification are labor fees. If modifications or installations need to be redone again for any reason you will be billed again.
